Terms of service
1.) Scope of Application
These General Terms and Conditions apply, in their version valid at the time of contract conclusion, to all business relationships between Kioskio GmbH, Seuzach, and its customers.
They form an integral and supplementary part of all orders and purchases concluded in writing, online, or in person.
2.) Offers
The assortment displayed on kioskio.ch does not constitute a legally binding offer.
All representations on the website are non-binding.
When a customer places an order via the internet, email, mobile device, telephone, or fax, they are submitting a binding offer to conclude a purchase contract.
The customer then receives a confirmation of receipt of the order. This confirmation does not constitute acceptance of the offer by Kioskio GmbH.
Kioskio reserves the right to reject an order without stating reasons. A legally binding purchase contract is only formed upon the dispatch of an order confirmation by Kioskio GmbH or upon payment of the goods/services.
Decorative items shown in images are not part of the offer unless expressly listed and described as such.
Accessories and decorative objects must be purchased separately.
Kioskio GmbH assumes no liability for the accuracy, completeness, timeliness, or reliability of the information provided — including availability, location, price, or any product details such as designer, manufacturer, era, color, dimensions, material, weight, condition, or furniture type.
3.) Prices
All prices are gross, including VAT, and subject to additional pickup, delivery, or assembly costs, which are individually quoted.
4.) Retention of Title
Until full payment of the purchase price has been received, all goods remain the property of Kioskio GmbH.
5.) Vouchers
Vouchers are accepted only for the amount stated on the voucher.
Validity and redemption status are determined by Kioskio’s internal documentation.
Unless otherwise stated, vouchers are valid without limitation.
If the purchase value is lower than the voucher amount, the remaining balance will be reissued as a new voucher.
Cash refunds are excluded.
Vouchers may be used for all products and services offered by Kioskio, except for third-party work performed on behalf of Kioskio.
6.) Warranty / Guarantee
Kioskio GmbH primarily trades in used goods and unique vintage pieces.
Therefore, statutory warranty obligations cannot be upheld.
The law permits exclusion of such warranty obligations, and accordingly, any warranty is excluded to the extent permitted by law.
In particular, rescission (cancellation) and price reduction are excluded.
Otherwise, the provisions of the Swiss Code of Obligations (CO) shall apply.
The buyer must inspect the goods immediately upon purchase or receipt for any defects.
Visible defects and signs of use are deemed accepted as found.
Subsequent or hidden defects discovered later do not entitle the buyer to free repair or return.
The principle “purchased as seen” applies.
Excerpt from the Swiss Code of Obligations:

Exclusion of warranty (CO Art. 199): An agreement excluding or limiting the seller’s warranty is invalid if the seller has fraudulently concealed the defects.

Known defects (CO Art. 200): The seller is not liable for defects known to the buyer at the time of purchase. For defects that could have been recognized with ordinary attention, the seller is only liable if their absence was expressly guaranteed.
7.) Returns / Exchange
There is no right of return or exchange.
If, as a gesture of goodwill, a return or exchange is accepted, a voucher will be issued for the amount paid, minus any transport costs, value-reducing defects, damages, or depreciation since purchase.
Light sources and bulbs are excluded from any warranty.
All further claims are excluded.
A handling fee of CHF 100.– will be charged for each accepted return.
8.) Copyright
All copyrights to the website, exhibitions, and related content (including but not limited to texts, images, and graphics) remain fully with Kioskio GmbH.
It is strictly prohibited to copy, download, reproduce, or otherwise use such materials for personal or commercial purposes without prior written consent.
9.) Transport / Assembly
Upon request and for an additional charge, Kioskio delivers purchased objects to the buyer or to a third party designated by the buyer and, upon express request, provides assembly services.
In the event of damage or loss, Kioskio’s liability is limited to the agreed purchase price.
Insurance coverage for collected goods, or for goods exceeding the purchase price in value, is the sole responsibility of the buyer.
Any damages or defects must be reported immediately upon discovery, both by phone and in writing.
Otherwise, no liability can be assumed.
Delayed delivery — regardless of cause — does not entitle the buyer to withdraw from the purchase or make any claims of any kind.
10.) Applicable Law
Exclusively Swiss law applies.
